Rob Cepielik has over thirty years of experience assisting companies facing complex litigation, investigation, and regulatory issues.

He joined Berkeley Research Group after retiring as a senior partner at a Big Four firm.

As a forensic accountant, Mr. Cepielik has performed numerous forensic accounting, compliance, and litigation support engagements, assisting companies and their counsel investigating allegations of:

  • Filing false claims with federal and state government agencies
  • Stark and Anti-Kickback violations
  • Financial statement accounting, disclosure, and internal control issues
  • Bribery and corruption activities
  • Employee theft and defalcations
  • Other alleged controls, policies, and ethics violations

On the litigation front, Mr. Cepielik has been engaged to assist clients in both testifying and non-testifying roles. His engagements have included:

  • Qui tam matters
  • Damages and lost profits analyses
  • Contractual disputes
  • Payor provider disputes
  • Purchase price disputes
  • Shareholder and derivate actions
  • Other sundry matters

Mr. Cepielik has served as an expert witness and testified in federal and state courts before grand juries and arbitration panels as an expert and fact witness. He has been an expert in International Chamber of Commerce arbitrations and has served as an accounting neutral in post-acquisition dispute matters. In his capacity as a forensic accountant, he has met with regulatory and law enforcement agencies on numerous occasions and has assisted clients to resolve matters with the US Department of Justice based on its “Ability to Pay” methodology and with CMS under its self-disclosure protocol.

Mr. Cepielik has assisted companies in the analysis of the current state and effectiveness of corporate compliance programs. He has performed risk assessments, identifying risk and program gaps, and has prepared action plans designed to create or enhance preventative and detective controls, along with policies and procedures designed to help mitigate compliance risks. He has served as an Independent Monitor for a company in connection with its settlement with the US Attorney’s Office. He has met with boards of directors, audit and compliance committees, financial institutions, private equity funds, and regulatory and law enforcement agencies regarding forensic investigation and compliance matters.

Mr. Cepielik is a Certified Public Accountant (licensed in Pennsylvania, Florida, New York, and Missouri) and a Certified Fraud Examiner.

Mr. Cepielik has experience in industries including healthcare, life sciences, consumer and industrial products, and financial services. He has led significant matters in the UK, the EU, Latin America, the Caribbean, Japan, Korea, China, Singapore, and other Asia-Pacific countries.
