Jeffrey Klenk

Jeffrey Klenk is an economic consultant with experience analyzing both liability and damages issues associated with alleged anticompetitive conduct. Such conduct has included allegations of price fixing, exclusionary rebates, and resale price maintenance. He also has significant experience analyzing issues associated with possible class certification, particularly in the context of alleged price fixing. 

In addition to competition issues, Mr. Klenk has experience analyzing damages in intellectual property matters. He has particular expertise, for example, in calculating potential damages stemming from at-risk generic launches (under the Hatch-Waxman Act). More generally, he has determined damages on matters stemming from various forms of commercial litigation such as breach of contract.

Mr. Klenk also has experience relating to the economics of certificate of need laws, having offered expert testimony in regard to a constitutional challenge to Virginia’s CON requirement for certain medical devices. In that matter, Mr. Klenk used econometric analysis to isolate the effects of Virginia’s CON requirements and to determine the volume of interstate commerce that was not flowing into Virginia as a result of those requirements.

In addition to economic consulting, Mr. Klenk has extensive teaching experience, having taught dozens of online classes for Pennsylvania State University's World Campus. These classes have included micro/macroeconomics, labor economics, and econometrics. He has also served as an adjunct faculty member at George Washington University and Catholic University.
