Walter Vandaele

Dr. Walter Vandaele is a managing director at BRG with expertise in antitrust economics, industrial organization, and econometric and statistical analyses.

He focuses his practice on competition and commercial damages valuation issues arising in antitrust, patent infringement, breach of contract, and other types of commercial disputes. He has submitted oral and written testimony in numerous federal and state courts, in mediation and arbitration matters, and in regulatory proceedings in the United States and abroad. He has consulted and testified most extensively on engagements involving the pharmaceutical and biotechnology industries but also has experience in numerous other industries, including telecommunications, computer software, uranium mining and enrichment, and plastics additives.

In his antitrust engagements, Dr. Vandaele has analyzed such issues as price bundling, loyalty rebates, exclusive dealing, prospective merger impacts, and average wholesale price drug reimbursement. In patent litigation, he has analyzed patent infringement damages, patent-related sources of a drug’s “commercial success,” and economic factors associated with preliminary injunctions.

More generally, Dr. Vandaele’s consulting engagements have ranged from analyzing lost-profit and lost-value damages associated with contract and shareholder litigation to evaluating the “adequacy” of competition in regulatory proceedings for registering new importers of narcotic raw materials. Over the past several years, he has also provided expert economic consulting in the area of multilevel marketing (MLM) that has involved disputes with the Federal Trade Commission (FTC).

Prior to establishing his practice in litigation consulting, Dr. Vandaele served at the FTC, as economic advisor at the Bureau of Competition, and as assistant director for regulatory evaluation at the Bureau of Consumer Protection. His previous academic affiliations include Harvard Business School, the departments of economics at Harvard University, Massachusetts Institute of Technology, Georgetown University, and Virginia Polytechnic Institute, and the University of Chicago.
