College Refund Class Actions Face Damages Hurdles

Jon Tomlin and Hassan Faghani write that college and university students have brought dozens of class actions seeking a refund of tuition payments and other fees after their schools moved from in-person to online instruction in response to the COVID-19 pandemic. They also discuss how consumers in other class actions have sought restitution in the form of the difference between the price they paid for a product or service and the market value of the allegedly inferior product or service that they received.
