We support merger proceedings, including cases involving local and regional markets, with specific expertise in the retail, energy and automotive sectors. We have substantial experience in damages estimation in cartel and abuse of dominance disputes, as well as in digital markets. We also support clients on State aid and regulatory matters.

How We Can Help

Mergers

We provide rigorous economic analysis of competitive effects in Phase I and II merger investigations. Our work covers market definition, competition concerns, closeness of competition, efficiency analysis and remedy design. We also provide feasibility studies at earlier stages of transactions.

Cartels and Anticompetitive Agreements

We advise clients on horizontal and vertical agreements and assess risk exposure and competitive effects in authority investigations and internal reviews. We use economic theory and empirical analysis to establish the effects of alleged conduct.

Litigation, Damages and Arbitration

We act as independent experts in court and arbitration proceedings for both claimants and defendants. Our work spans counterfactual analysis, overcharge and pass-on estimation and damages quantification across large, multijurisdictional cases. We also provide risk assessment before formal legal proceedings are initiated.

Abuse of Dominance

We apply an effects-based approach to Treaty on the Functioning of the European Union (TFEU) Article 102 matters, combining economic theory with empirical analysis. We undertake assessments of exclusionary conduct, including as-efficient-competitor tests across a range of industries.

State Aid and Foreign Subsidies Regulation

We assist companies and public authorities with State aid control and Foreign Subsidies Regulation matters. We apply the market economy operator principle and provide economic evidence on compatibility and subsidy criteria.

Regulated Industries and Market Design

We advise firms on access regulation, rate setting and market-design issues. This includes development of auction mechanisms and access arrangements in communications and energy markets.
