BRG’s Berlin office provides advisory services in competition economics with a focus on mergers, cartels, abuse of dominance, State aid and regulation. Our professionals have backgrounds at leading competition authorities and academic institutions and combine academic rigour with practical experience.

Whether a client faces a complex matter before the European Commission, Bundeskartellamt, another competition authority or a national court, our team draws on the firm’s wider capabilities—spanning economics, disputes and investigations, corporate finance and performance improvement—to provide support.

The Berlin office is one of our major European hubs and works closely with our offices in Brussels, London, Milan, Munich, Paris and Rome.

We support clients in administrative proceedings, litigation and arbitration. We apply the latest economic theory and econometric analysis to issues examined by competition authorities and courts. We deliver analysis that is rigorous, transparent and aligned with the legal framework applicable to each case.

Our work spans energy and raw materials, digital markets, retail, financial services, manufacturing, transportation and pharmaceuticals. This depth of sector knowledge helps us deliver industry-informed analysis grounded in genuine expertise.

How We Can Help

Mergers

We provide rigorous economic analysis of competitive effects in Phase I and II merger investigations. Our work covers market definition, competition concerns, closeness of competition and remedy design. We also provide feasibility studies at earlier stages of transactions.

Cartels and Anticompetitive Agreements

We advise clients on horizontal and vertical agreements and assess risk exposure and competitive effects in authority investigations and internal reviews. We use economic theory and empirical analysis to establish the effects of alleged conduct.

Litigation, Damages and Arbitration

We act as independent experts in court and arbitration proceedings for both claimants and defendants. Our work spans counterfactual analysis, overcharge and pass-on estimation and damages quantification across large, multijurisdictional cases. We also provide risk assessment before formal legal proceedings are initiated.

Abuse of Dominance

We apply an effects-based approach to Treaty on the Functioning of the European Union (TFEU) Article 102 matters, combining economic theory with empirical analysis. We undertake assessments of exclusionary conduct, including as-efficient-competitor tests across a range of industries.

State Aid and Foreign Subsidies Regulation

We assist companies and public authorities with State aid control and Foreign Subsidies Regulation matters. We apply the market economy operator principle and provide economic evidence on compatibility and subsidy criteria.

Regulated Industries and Market Design

We advise firms on access regulation, rate setting and market-design issues. This includes development of auction mechanisms and access arrangements in communications and energy markets.

Innovation, Patents and Copyright

We provide expert economic advice at the intersection of antitrust and intellectual property. Our experience covers standard-essential patents, copyright policy and the role of innovation in merger analysis.
