A certified class of more than 60,000 technical, creative, and research and development (R&D) employees (the plaintiffs) alleged that their pay had been suppressed over a five-year period due to antipoaching agreements reached by the chief executive officers of the four prominent company defendants. Through rigorous economic and quantitative analyses, BRG experts showed that intercompany hiring by the defendants was statistically significantly greater during the class period than prior to it; and marginally statistically significantly greater during the class period than after it. BRG experts also effectively rebutted the analysis undertaken and opinions reached by the four plaintiffs’ experts.
