Society of Construction Law North America 2022 Conference

The Society of Construction Law North America (SCL NA) hosted its inaugural annual conference. The theme for the conference was “Rocky Mountain Highs and Lows: Lessons Learned in Managing Construction Disputes.”
Several BRG professionals took part in panels on July 7:
- Jeff Ottesen participated in “Mitigation v. Acceleration: What’s the Difference?” Topics included contractor-delays; voluntary, instructed, and constructive acceleration in the context of how it arises; and what generally has to be shown to recover.
- John Jerz participated in “Disruption/Loss of Productivity Claims.” Panelists discussed causes of disruption and loss of productivity; the impact COVID has had on productivity of construction projects; and methods to calculate and value productivity loss.
- Jon Perry participated in “Delay and Disruption Claims: Old Concepts, New Approaches.” The panel highlighted and contrasted the “modern” and “traditional” methods of delay and disruption claims.
The conference explored themes related to complex dispute resolution and construction law best practices, as the industry adapts and rises above the challenges in 2022. Anamaria Popescu is the chairman of the SCL NA and provided welcome remarks. Dara Hendrix and Pasha Ameli are on the board of directors of the SCL NA and conference planning committee. BRG was the platinum sponsor of the conference.
